CAMDOG PRIVACY POLICY

ALL DATA SUBJECTS ARE REQUIRED TO READ THIS POLICY TO UNDERSTAND HOW THE COMPANY COLLECTS, USES OR PROCESSES PERSONAL INFORMATION AND WHAT RIGHTS REGARDING THIS INFORMATION DATA SUBJECTS DO HAVE.

  1. What Is It For?

    1. Parties to This Policy.

      This Privacy Policy (hereinafter referred as “the Policy”) defines the regulation of the relationship between Camdog Inc., incorporated under the laws of State of Delaware, USA, located at 2093 Philadelphia Pike 2076, Claymont, DE 19703 (including its subsidiaries, affiliates, agents, and assignees) (“Camdog”, “we”, “us”, “our”) and you (“you”, “your”, “user”) regarding the use of your Personal information collected and processed during the operation of the Website, Application, and Services offered through the Website and Application, and your access to Account on the Website/Application and to Services.

      This Policy applies to every individual whose Personal information is collected by the Company through the Website and Application and other persons whose Personal information is lawfully disclosed to and processed by Camdog (“Data Subjects”).

    2. Purpose of This Policy.

      We want to simplify the understanding of this Policy for you and through that provide you with a possibility to understand in a very clear and accessible way what your exact Personal information we collect, use or process, why we do that, in which way we do that, what rights regarding your Personal information you have and what consequences of these actions are.

    3. Data Subject Age.

      Please note that our Services are designed for people at least 18 years old. Nonetheless, we understand that Data Subjects under 13 may be captured and their Personal information processed. In this case, we strongly advise you not to save and process Personal information of these individuals without the consent of the parents or legal guardian(s) of the child.

      We do not knowingly collect and process Personal information of minors. If you discover that User or Visitor of our Services, Website or Application stores, collects or processes personal information of children using our Services, Website or Application, please contact us on contact@camdog.ai.

  2. Definitions.

    Throughout this Policy we use the following definitions:

    • Account” means the personal account of User on the Website and Application, after registration of which User may receive the Services under the conditions specified in these Terms of Service.

    • Affirmative authorization” means an action that demonstrates the intentional decision by Data Subject to opt-in to the collection and processing of personal information.

    • Authorized agent” means a natural person or a business entity (its authorized representative) duly registered with the competent state authority that Data Subject has been authorized to act on behalf of.

    • Application” means a software installed from various app stores, accessed or otherwise used by you or your devices (mobile phones and tablets) through which you can access the Camdog Services.

    • Business purpose” means:

      • Provision of the Services that may include, but is not limited to, monitoring the object or space specified by User, creating and saving logs as to the movements detected and pictures of the moving subjects or objects, creating graphic images of moving subjects or objects, tracking the behavior of Visitor on the Website, etc.

      • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and reacting to the implied break of security, privacy or data protection.

      • Debugging to identify and repair errors that impair existing intended functionality.

      • Short-term, transient use, provided the personal information that is not disclosed to another third party and is not used to build a profile about Data Subject or otherwise alter an individual Data Subject’s experience outside the current interaction, including, but not limited to, the provision of the Services, operation of the Website and Application and other purposes that constitute Camdog’s legitimate interest.

      • Performing Services with or without third party analytics and statistics tools, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, analytics, or providing similar functions aimed at provision of the Services, development of the Services, Website or Application, and other purposes that constitute Camdog’s legitimate interest.

      • Undertaking activities that improve, upgrade, or enhance the customer experience and ensure the smooth ordinary course of business.

    • Collects,” “collected,” or “collection” means buying, renting, gathering, obtaining, receiving, or accessing any Personal information pertaining to Data Subject by any means embodied in the Services, Website and Application. This includes receiving information from Data Subject, either actively or passively, or by observing Data Subjects’ behavior.

    • Commercial purposes” means to advance a person’s commercial or economic interests, such as by inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or affecting, directly or indirectly, a commercial transaction, except as the purpose of engaging in speech that state or federal courts have recognized as noncommercial speech, including political speech and journalism.

    • Personal information”, “Data” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Data Subject or household.

    • Website” means Camdog website located on https://camdog.ai, its subdomains through which Camdog Services are provided.

    • Third-party” means a person who is not Camdog, User or Visitor of the Camdog’s Services, Website or Application, but whose Personal information is collected and available to Camdog, its Users and Visitors, including natural persons detected using the Camdog’s Services, Website or Application as well as business partners providing statistics or analytics tools to be used for the Business purposes.

    • User” means any person or entity (its representative) who creates an Account in order to use Services.

    • Verifiable data subject (consumer) request” means a request that is made by Data subject, by Data Subject on behalf of Data Subject’s minor child, or by a natural person or a person registered with the competent state authority, authorized by Data Subject to act on their behalf, and that Camdog can reasonably verify by lawful means to be the Data Subject about whom the Company has collected Personal information.

    • Visitor” means a person surfing the Website or Application without the Account created and without the access to the Services obtained.

  3. What Personal Information Do We Collect?

    We collect Personal information to provide you with the Services. We do not collect it to sell or resell, either raw or processed, your Personal information to any third parties.

    The types of Personal information we collect and process include:

    • Account information, namely the information about you that we need in order to register and maintain your account: first name, second name, email address, mobile phone number, login, password required to enable you to pass the authorization and gain the access to our Services, account ID, account name;

    • Geolocation data: country, state, city, street, house number.

    • Technical information: Personal data preserved in the log, as well as your device model.

    • Third-party data: Personal information from the social network site (if you decide to create your Account based on your account in one of the social network sites);

    • Cookies data and other information generated through automated means: session cookies, stored cookies and other personal information prescribed by the Cookies Policy.

    • Other personal information: the information you provide us with when contacting us through the email address for inquiries, “Contact Us” feature, customer support tools in the Website and Application and other points of contact.

    Data subjects may:

    • request Camdog to disclose Personal information relating to them, namely: categories of personal information which Camdog has collected about Data Subjects; categories of sources from which Personal information is collected; purpose for collecting or processing of Personal information; categories of third parties with whom Camdog shares Personal information, if any; specific pieces of Personal information which Camdog has collected about the Data Subjects;

    • receive the information requested pursuant to Section 3(i) from Camdog upon the Data Subject’s verifiable request;

    • exercise other rights granted by the privacy, data protection and surveillance laws of the State of Delaware.

    We do not use the personal information we collect to make automated decisions or profiling.

    Please note that some information collected through the use of specific features of the Services, such as captured and saved images of people and their voices, may be considered personal information. In such a case, you shall consult the privacy, data protection and surveillance laws applicable to you and/or valid in the jurisdiction you are in, as we shall not be held liable for any violation of these laws (as prescribed by the Terms of Service).

  4. What Are the Purposes of Collecting?

    We use the collected Personal information for the following purposes:

    • provide you with our Services;

    • register, maintain and manage your Account and profile;

    • identify and authenticate you when you try to access your Account;

    • ensure the smooth and enhanced experience with our Services, Application and Website;

    • process your payments and orders for our Services;

    • enable you to receive notifications and information related to the Services;

    • ensure safety and security of our Services and prevent the misuse and abuse of the Services, Website and Application;

    • customer support and communication with Data Subjects;

    • allow the usage of third-party services (such as social network sites) and products (such as devices and other hardware you need to run our Website and Application);

    • perform analytics and collect statistical data;

    • develop, enhance, update and manage our Services, Website and Application as well as other products and services we design and develop to offer you in course of business;

    • protect you against fraud and other crimes as well as claims and other kinds of legal liability;

    • comply with applicable laws, legal requirements, relevant industry standards and policies, including our Cookies Policy and Terms of Service.

    If we obtain your personal data in any other way, we will provide you with a specific notice at the time of collection, and obtain your consent, if required by applicable law.

    You may encounter the links to third party sites on our Website or Application. Please be careful when entrusting them with your Personal information. These websites and suggested applications are governed by their own privacy policies. We strongly advise you to look through their privacy policies prior to any transactions or activity on such third-party websites or applications.

  5. Whom May We Disclose Personal Information Data to?

    We do not cooperate with any authorities responsible for your safety such as police, ambulance, etc. Please note that any Personal information we collect and process is either retained for the purposes explained above or is deleted after the expiry of the retention period, under the newly adopted or amended law, pursuant to your request or request from the law enforcement bodies.

    We may disclose some of your personal data to third-party analytics systems and payment processors. The extent of such disclosure will depend on the privacy policies adopted by such third parties, so we strongly advise you to consult with them prior to commencing payment or opting-in or opting-out of the tracking.

    Also, we may share your Personal information with our affiliates and subsidiaries, as well as authorized representatives and contractors, if any. We bind the contractual promises not to use your Personal data for the purposes exceeding what is necessary to perform services on our behalf or comply with legal requirements.

    We reserve the right to transfer any Personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

    We may be obliged to disclose certain information to the law enforcement services, courts, and state authorities. We do so in order to:

    • comply with the law or legal process (such as a court order or subpoena);

    • establish, exercise or defend our legal rights;

    • prevent physical or other harm or financial loss;

    • in connection with an investigation of suspected or actual illegal activity; or

    • otherwise, provided that you give your consent.

    We do include the means of control and appropriate warranties to the agreements and contracts with our subprocessors and partners granted access to your Personal information.

    Among third parties who may receive your personal information through our Services, Website or Application, the following categories of our contractors may be present:

    • payment processors;

    • cloud services providers;

    • marketing and advertising platform providers;

    • data analytics providers;

    • development services suppliers;

    • vendors assisting us in enhancement of the safety and security of our Website, Application or Services;

    • auditors, accountants, lawyers, and other professional service providers.

  6. How Can You Exercise Your Rights?

    Data Subjects can exercise any and all of the rights aforementioned by sending a verifiable request to one of the following means of communication:

    We will provide you with the requested information free of charge only upon a verifiable request but not more than twice per 12 months period. We will try to do so no longer than within 45 days of receiving a verifiable consumer request. In case your request is too complicated or detailed, we reserve the right to extend this time period once by an additional 45 days when reasonably necessary, taking into account the complexity and number of requests. We will notify you of such an extension. Still, we reserve the right to charge you with a US $100 (one hundred dollars) fee for its requests that are manifestly unfounded or excessive, in particular, because of their repetitive character or refuse to act on the request and notify you of the reason for refusing the request.

    Camdog is not obliged to:

    • retain any Personal information collected for a single transaction if, in the ordinary course, such information about Data Subjects is not retained;

    • re-identify or otherwise link any data that, in the ordinary course, is not maintained in a manner that would be considered personal information.

    Camdog is not obligated to provide a person with information pursuant to their requests if we cannot verify that the person making the request is Data Subject about whom we have collected information, or is a person authorized by you to act on your behalf. In order to verify that the person in question is, in fact, you, we may ask you:

    • to provide the authorized agent with written permission to do so or equip the agent with a valid power of attorney; and

    • to verify your own identity directly with us.

  7. How Do We Protect Your Personal Information?

    We store Personal information in the United States of America. We use service cloud providers registered and located within the U.S. and prefer servers placed in the U.S. region.

    Our cloud storage provider is Google Inc.

    We also implement suitable security measures to protect privacy and increase the level of safety and security of Personal information we collect and use to provide you with the Services and proper operation of the Website and Application.

    Some of your Data may be accessed and processed by the contractors registered outside the U.S. Nevertheless, we implement the appropriate organizational and technical measures to ensure at least the same level of personal information protection as it is granted by the laws we must obey.

  8. How Long Do We Retain Your Data?

    We will store and process Personal information for as long as your account is activated or the contract is valid and until the end of the retention period required by the applicable laws (i.e. for tax administration purposes) or after the deletion of your Account if its storage is justified by legal obligation or our own legitimate interest to do so (e.g. your Account has been previously noticed or suspected in participation in the fraudulent schemes or any other illegal activity, or an unsettled or unresolved legal claim is present). We will delete Personal Information as soon as any legal grounds for retention will cease to exist.

    We will delete Personal information from our databases, and we will request our processors to delete Personal information, too, upon your request for deletion of Account via the Website or Application functions or by verified request at our email address.

  9. Updates to Privacy Policy

    We may change this Privacy Policy from time to time. In case of any major changes, we will notify you; if the collection of Personal information is repurposed or any other grounds for seeking your authorization to process your personal information arise, we will ask you for your consent to do so.

    We encourage you to periodically review this Policy for the latest information on our privacy and data protection practices.

CAMDOG TERMS OF SERVICE

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY USING THE CAMDOG SERVICES, YOU AGREE TO BE BOUND BY THE (1) CAMDOG TERMS OF SERVICE AND (2) CAMDOG PRIVACY POLICY

This website is owned and operated by Camdog Inc. and its authorized representatives and vendors (collectively “Camdog”, “we”, “us”, or “our”).

  1. Definitions

    Camdog Services” (“Services”) means Application, Website, and software services accessible through the Website and Application, which may be provided to you by Camdog in accordance with this Terms of Service.

    Application” means a software installed from various app stores, accessed or otherwise used by you or your devices (mobile phones and tablets) through which you can access the Camdog Services.

    Website” means Camdog website located on https://camdog.ai, its subdomains through which Camdog Services are provided.

    User” means any person or entity (its representative) who creates an Account in order to use Services.

    Account” means the personal account of User on the Website and Application, after registration of which User may receive the Services under conditions specified in these Terms of Service.

    Terms that are not defined in Section 1 of this Terms of Service shall be interpreted in accordance with the text of this Terms of Service.

  2. What Are You Agreeing To?

    1. The Parties to this Agreement.

      These Terms of Service describe a contractual relationship (“Agreement”, “Terms”) between you (“you”, “your”, “user”) and Camdog Inc. (including its subsidiaries, affiliates, agents, and assignees) (“Camdog”, “we”, “us”, “our”), regarding your use of the Website, Application and Services offered through the Website and Application, and your access to Account on the Website/Application and to Services.

    2. Changes to this Agreement.

      Camdog may unilaterally decide to change this Agreement from time to time, provided, however, that such changes will not impose additional obligations on you with respect to actions you took before the change became effective unless you specifically agree to such changes (for example, by confirming a payment transaction). Continued use of Camdog Services after changes have been posted will indicate your acknowledgment and agreement to be bound by the revised Agreement. Camdog will make a reasonable effort to inform you of such changes, but it is your responsibility to review this Agreement from time to time to see if it has been changed.

    3. Eligibility.

      To be eligible to use the Services, you must be at least 18 years old. If you are under 18, you may use the Camdog Services only with involvement and the consent of your parent or guardian.

      You represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You may authorize only individuals you trust to use your Account on your own risk.

      If you’re using the Services on behalf of a legal entity, you represent and warrant that you have the right and authority to enter into this Agreement on that entity’s behalf and bind it to terms and conditions of this Agreement (in this case, the term “you” in this Agreement refers both to you personally and to that entity collectively). Moreover, you represent and warrant that the Services are used in good faith, in compliance with all applicable privacy, data protection, and video- and audio surveillance laws and company security policies and bylaws, and constitute a part of a properly and lawfully organized security policy.

  3. Access and Use of Services

    1. Creating an Account.

      To access and use Camdog Services, you are required to create an Account. Account registration requires you to submit certain information to us. When you provide information to Camdog, you agree to provide only true, accurate, current, and complete information about yourself and you agree not to misrepresent your identity or your account information. You further agree to keep your account information up to date and accurate. Camdog is not liable for any loss or damages arising from your failure to maintain the confidentiality of your Account. You agree to notify Camdog about breach of security of your Account or any unauthorized access immediately.

    2. System and Equipment Requirements.

      The use of Camdog Services requires Internet access and the necessary hardware, namely IP-camera(s) with a static address. The Camdog Services may not be accessible unless the above-mentioned is provided. The Services, Application and Website are provided “as is”. User shall consult the system requirements prior to obtaining access to the Services.

      Camdog may not be held liable for Users’ inability to use the Services provided that the reasons for inability are related to or caused by hardware in-embedded software versions conflict, expired license, User’s Internet access provider default or other reasons that have arisen in the absence of Camdog’s default and without the prejudice to Section 3.8. hereof.

    3. Granting the License.

      All rights, titles, and interests in the Services and in connection with Services are owned by Camdog, its licensors, affiliates, or designated third parties, if any.

      Camdog grants you a revocable, limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for your personal, non-commercial use (“License”). Businesses entities may use the Services for their lawful business purposes only, but may not include Services to or in their own goods or services offered to the customers during their own business activities without the prior consent of Camdog. License does not include any right to resell Services, or otherwise make the Services available for third parties.

      Provided that you use Camdog Services as a part of the goods or services you offer in course of your business activities, Camdog may not be held liable for any infringements of third party rights or violations of the applicable data privacy, data protection, or video- and audio surveillance laws.

    4. Lawful Use of Services.

      You are responsible for all of your activity in connection with the Services. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Services.

      While using Camdog Services, you are solely responsible for compliance with privacy, data protection, security, or audio- or video surveillance laws and other laws applicable in your jurisdiction, including but not limited to:

      (1) any laws or regulations relating to the recording or sharing of video or audio content, (2) any laws or regulations requiring that notice be given to or that consent be obtained from third parties with respect to your use of the Services (for example, laws or regulations requiring you to display appropriate signage advising others that audio or visual recording is taking place), and/or (3) any laws or regulations requiring that, if you use your property as a workplace, you comply with laws governing the monitoring of employees, etc. The list may vary depending on the jurisdiction where the Services are used, its legal framework and bylaws and policies adopted by the legal entity that the User is authorized to act on behalf of. The final scope of responsibilities and obligations to be fulfilled by User shall be subject to the User’s consideration.

      You are not authorized to use the Services if your use of the Services is prohibited by applicable laws. We are not and shall not be held responsible for your use of the Services in a way that violates the law. You shall consult the legal framework applicable to you and take appropriate organizational and technical measures before accessing and using the Services.

    5. Prohibited Use.

      While using the Camdog Services, you agree that:

      • You will not engage in any activities related to the Services or use the Services for the purposes that violate any applicable law, statute, regulation, bylaw, internal company policy or ordinance or breach this Agreement or any other agreement or policy you have with Camdog;

      • You will not use any device, software, routine, file or other tool or technology, including but not limited to any viruses, trojan horses, worms, time bombs or cancelbots, intended to damage or interfere with the Services or to surreptitiously intercept or expropriate any system, data or personal information from the Services;

      • You will not use the Camdog Services in connection with any commercial endeavors except as provided above;

      • You will not collect data from Camdog either from authorized and not authorized zones through automated means (bots, spiders, scrapers or equivalent means), or by establishing fake user accounts or by anonymous proxy servers or equivalent measures, or by circumventing any technical measures to prevent forbidden activity in the Application or the Website;

      • You will not attempt, in any manner, to obtain the password, account, credentials, or other security information from any other User;

      • You will not use the Services in a manner that: violates the intellectual property rights, rights to privacy, reasonable expectation of privacy, or any other rights of anyone else; is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable; violates the security of any computer network, or cracks any passwords or security encryption codes.

      Illegal and/or unauthorized use of the Camdog Services will be investigated, your right to use or access the Services will be terminated and appropriate legal action may be taken, including without limitation, civil, criminal, and injunctive redress.

    6. Consent to Contact.

      By using the Camdog Services, you give us consent to receive emails, notifications, information (“Notifications”) at the email address or to the mobile phone number you provide to Camdog (including telephone calls) for any purposes relating to this Agreement. You also give a consent to receive Notifications on your enabled wireless device through the Application, Website, or through a personal computer. You agree to immediately notify us in the event of a change of your contact information. You will be solely responsible for any rates and charges that may apply.

    7. Closing Your Account.

      You may request to close your Account at any time. Upon Account closure, we will cancel any pending transactions unless otherwise is legally prohibited. You may not close your account to evade an investigation. You will remain liable for all obligations related to your Account even after the Account is closed. We will retain your information in accordance with our Privacy Policy and any applicable state law, rule or regulation.

      Please note that we may not store backup or other copies of the information that used to be accessible through the deleted Account. In such a case, you shall save all images and other information provided during the provision of the Services in case you are about to commence or envisage the demand to provide the evidence in ongoing civil, criminal, or injunction redress.

    8. Changes to Camdog Services.

      Camdog reserves the right, in its discretion, to change, modify, discontinue, or temporarily suspend the Services, impose limits on certain features of Services, restrict or terminate your access to the Services or your account at any time without prior notice. You agree that it may be necessary to install software updates to use the Services, and you agree to promptly install such updates we provide.

      Access to the Camdog Services may from time to time be unavailable, delayed, limited or slowed due to, among other things:

      • servers, networks, hardware failure (including your own device), telecommunication lines and connections, and other electronic and mechanical equipment;

      • software failure, including among other things, bugs, errors, viruses, configuration problems, incompatibility of systems, utilities or applications, operation of screening programs, unreadable codes, or irregularities within particular documents or other content;

      • overload of system capacities;

      • damage caused by severe weather, earthquakes, wars, insurrection, riots, civil commotion, accident, fire, water damage, explosion, mechanical breakdown or natural disasters;

      • interruption (whether partial or total) of power supplies or other utility of service; strike or other stoppage (whether partial or total) of labor;

      • governmental or regulatory restrictions, court decisions or other external intervention; or

      • any other cause (whether similar or dissimilar to any of the foregoing) whatsoever beyond the control of Camdog.

  4. Content

    We may use your Content and any other information you provide to us while using the Services, for the limited purposes of providing, maintaining and improving Services, protecting you, developing new Services, and as otherwise set forth in our Privacy Policy, on the basis of your perpetual, irrevocable, non-exclusive, royalty-free, worldwide, sublicensable and transferable license granted to Camdog. For the purposes of this Terms, “Content” means certain materials (including, but not limited to text, graphics, video, images), that may be submitted to us in the course of using the Services.

    Audio- and video surveillance. In case the jurisdiction you are in prohibits the recording of the voice or behavior of third parties without prior notice of such a recording and the consent to be recorded, Camdog shall not be held liable for violation of such applicable law, statute, regulation, bylaw, internal company policy or ordinance. You shall consult the applicable legal framework and implement appropriate lawful organizational and technical measures, including, but not limited to, placing special signs, using law-compliant language of notice, and collecting the consents to be recorded, to ensure compliance with the applicable privacy, data protection, as well as audio- and video surveillance and other applicable federal, state and local laws.

    Feedback You Provide. If you submit comments or provide another feedback to us in any way, you agree that we can use it without any restriction or compensation to you. If we accept your submission, we do not waive any rights to use similar or related ideas or feedback previously known to us, developed by our employees, or obtained from sources other than you.

    If you send us any communications as to proposed modifications of the software or marketing, they are considered non-confidential, and we will have no obligation to keep such information in secret, to refrain from using such information, or to compensate you for the receipt or use of such communications.

  5. Payment terms. Refund Policy

    1. Free Trial.

      You may use Camdog Services for free during 1 (one) day period (“Trial period”). The Trial period starts from the day you create an Account and start using Services.

    2. Paid Services.

      After the end of the Trial period, you may access and use Camdog Services on a paid basis. We offer you different price plans for Camdog Services according to a number of services provided and your equipment capacity (“Plan”). More details on price plans are available here.

      You may use one of the available methods of payment to make one-time transactions to pay for using Services. The Services are available until the paid period is over, unless you decide to continue using Services under one of price plans available.

      We will automatically charge you for the next period. You can see the actual payment information in your account.

      We reserve the right, in our sole discretion, to refuse or cancel any of your orders and limit order quantity.

      You may cancel your Plan by contacting us, at any time, at your discretion. After cancellation, you will be refunded with money not used for the current paid period, excluding the maintenance fee (if applicable).

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMDOG SERVICES ARE PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS “AS IS” AND “AS AVAILABLE” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY ARE DISCLAIMED WHERE POSSIBLE. CAMDOG DOES NOT REPRESENT OR GUARANTEE THAT THE CAMDOG SERVICE WILL BE FREE FROM LOSS, CORRUPTION, CYBER ATTACK, VIRUSES, INTERFERENCE, HACKING, MALWARE, OR OTHER SECURITY INTRUSION, AND CAMDOG DISCLAIMS ANY LIABILITY RELATING THERETO.

    IN NO EVENT SHALL COPYRIGHT HOLDERS OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. CAMDOG AND ITS AFFILIATES SHALL NOT BE RESPONSIBLE FOR ANY APPLICATION/WEBSITE INTERRUPTIONS, INCLUDING, BUT NOT LIMITED TO, SYSTEM FAILURES OR OTHER INTERRUPTIONS THAT MAY AFFECT THE RECEIPT, PROCESSING, ACCEPTANCE, COMPLETION OR SETTLEMENT OF PAYMENT TRANSACTIONS OF THE CAMDOG SERVICES. IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF AN IMPLIED WARRANTY, THE ABOVE EXCLUSION DO NOT APPLY TO YOU TO THE EXTENT COVERED BY SUCH AN IMPLIED WARRANTY WITHOUT PREJUDICE TO THE IMPLIED WARRANTIES THAT MAY BE AND THUS HAVE BEEN DISCLAIMED.

  7. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW CAMDOG AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, CONTRACTORS, AGENTS, LICENSORS HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF SERVICES. IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, CAMDOG AND ITS AFFILIATES ARE NOT LIABLE FOR ANY COMPENSATORY, DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), OR ANY OTHER LIABILITIES OR LOSSES WHETHER BASED ON BREACH OF AGREEMENT, BREACH OF WARRANTY, TORT, SERVICE LIABILITY OR OTHERWISE; NOR ARE CAMDOG AND ITS AFFILIATES LIABLE FOR ANY THIRD-PARTY CLAIMS OF ANY NATURE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS. NONE OF THE SERVICES WOULD BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, YOU OBTAIN FROM US THROUGH THE CAMDOG SERVICES SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT. NEITHER WE NOR ITS AFFILIATES SHALL HAVE ANY LIABILITY FOR ANY FAILURE OR DELAY RESULTING FROM ANY CONDITION BEYOND OUR REASONABLE CONTROL.

    CAMDOG DISCLAIMS FROM ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER USERS, WHETHER SUCH ACTS OR OMISSIONS OCCUR DURING THE USE OF THE SERVICE OR OTHERWISE.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAMDOG TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES EXCEED THE FEES ACTUALLY PAID BY YOU TO CAMDOG FOR THE CAMDOG SERVICES IN THE PRIOR 6 MONTHS (IF ANY) IMMEDIATELY PRECEDING THE DATE OF THE MOST RECENT CLAIM. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM.

    THE RISK OF LOSS AND TITLE FOR INFORMATION CREATED BY WEBSITE OR APPLICATION AND SENT YOU OR MADE AVAILABLE TO YOU THROUGH YOUR ACCOUNT, PASS TO YOU UPON THE SENDING OR MAKING AVAILABLE OF SUCH INFORMATION. WE STRONGLY SUGGEST THAT YOU BACKUP ANY IMPORTANT INFORMATION (FOR EXAMPLE, BY DOWNLOADING AND LOCALLY SAVING ANY SUCH INFORMATION).

  8. Disputes Resolution

    1. Disputes with Camdog.

      If a dispute arises between you and us, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. In the event of a dispute, we encourage you first to contact us at contact@camdog.ai to try resolving your problem directly with us.

    2. Mandatory Litigation.

      THIS SECTION AFFECTS YOUR RIGHTS, PLEASE READ CAREFULLY BEFORE AGREEING TO THESE TERMS OF SERVICE.

      Except as explicitly provided in this Agreement, any dispute or claim relating in any way to your access and use of the Camdog Services, or otherwise arising out of or relating to this Agreement or the Camdog Services that cannot be resolved directly between you and Camdog shall be resolved by the respective court of State of Delaware, USA.

    3. Restrictions.

      You and Camdog agree that any litigation shall be limited to the dispute between Camdog and you individually. To the fullest extent permitted by law, (i) no litigation shall be joined with any other; (ii) there is no right or authority for any dispute to be resolved on a class-action basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

    4. Exceptions to Informal Negotiations and Mandatory Litigation.

      You and Camdog agree that the following disputes are not subject to the above provisions concerning informal negotiations and mandatory litigation (i) any disputes seeking to enforce or protect, or concerning the validity of, any of your or Camdog 's intellectual property rights; and (ii) any claim for injunctive relief.

  9. Miscellaneous Provisions

    1. Intellectual Property.

      All intellectual property rights to all content, design, text, graphics, logos, compilations, and other matters to the Services, including without limitation copyrights, patents, trademarks, and trade secrets in the Services are owned by Camdog or one of its affiliates or licensors. The copying, redistribution, use, or publication of any part of the Services, unless expressly permitted in this Agreement, is strictly prohibited. Use of the Services does not give you ownership of any intellectual property rights in any of the content, documents or other materials you access.

      Our software is copyrighted by Camdog or its licensor(s) and may be protected by one or more patents owned by Camdog or its licensor(s).

      Any rights in and to trademarks, service marks, trade dressings and other intellectual property objects, whether registered by Camdog or not, are reserved and may be protected by one or more applications and certificates of registration owned by Camdog or its licensor(s). Camdog expressly forbids the unauthorized use of its logos, trademarks or other graphics to create links.

    2. Privacy.

      Please review Camdog’s Privacy Policy, which describes how we collect and use certain information that you submit to Camdog.

      We may not be held liable for any infringements to third party rights or violation of applicable law that have been imposed on you by the jurisdiction you are in. We may not be held liable for the lack of absence of required settings, preferences, features, as well as other organizational and technical measures mandatory for compliance with data protection and surveillance law that are in force in the jurisdiction you are in.

    3. Indemnification.

      You use the Services at your own risk and for your sole responsibility. You agree to indemnify, defend and hold us and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, and employees harmless from any claim, demand or liability, including reasonable attorneys' fees, related to your use of the Camdog Services or any violation of this Agreement or applicable law.

    4. Applicable Law.

      We operate and control the Camdog Services from our office in the State of Delaware, USA. All matters relating to Camdog Services and this Agreement, as well as any dispute or claim relating to Camdog, Camdog Services and/or this Agreement, shall be governed by all applicable Federal laws of the U.S. and the laws of the State of Delaware, without regard to its conflict of law provisions.

    5. No Life-Safety or Critical Uses of Camdog Services.

      You acknowledge and agree that the Camdog Services are not intended for a third-party emergency notification system. We do not guarantee that you will receive notifications in any given timeframe or at all. We will not dispatch emergency authorities to your home in the event of an emergency. All emergency events should be directed to appropriate response services. We make no warranty or representation that the use of the Camdog Services with any third-party product or service will affect or increase any level of safety or security.

    6. Open Source.

      Certain items of software included with the Services are subject to free and open-source software licenses (“Open Source Software”). Nothing in this Agreement limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable end user license for the Open Source Software.

      If required by any license for particular Open Source Software, Camdog makes available to you for download the source code to any of the Open Source Software ("Source Code") by written request to Camdog via the contact information set herein.

      By downloading/requesting the Source Code, you agree to the following:

      CAMDOG PROVIDES THE SOURCE CODE TO YOU ON AN "AS IS" BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. YOU HEREBY EXPRESS THE AGREEMENT THAT YOUR USE OF THE SOURCE CODE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMDOG AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SOURCE CODE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

      Camdog shall not disclose to you and provide you with the portions of Source Code not covered by an Open Source Software license. You are prohibited from reverse engineering or any other tool or method that may violate the intellectual property rights of Camdog and is not protected by the terms of the Open Source Software license.

    7. Software Updates.

      We may update our software, the content of the Application and the Website, as well as change the operation of the Services. You agree to such updates when uploading them (including through automatic installation of new updates available in settings of certain operating systems) without providing any additional notice to you or receiving any additional consent from you.

    8. Term and Termination.

      This Agreement will remain in full force and effect as long as you continue to access or use the Camdog Services, or until terminated in accordance with the terms of this Agreement. You may terminate your use of the Services at any time. We reserve the right to suspend or terminate your access to Camdog Services at any time without prior notice, in the case if we determine that you violate or fail to comply with this Agreement or applicable law. All provisions of this Agreement which, by their nature, should survive termination, shall survive termination, including, without limitation, warranty disclaimers and limitations of liability.

    9. Entire Agreement. Waiver. Severability.

      This Agreement constitutes the entire understanding between you and Camdog with respect to the use of the Camdog Services. This Agreement supersedes and replaces any and all prior oral or written understandings, proposals or agreements between Camdog and you regarding the Camdog Services. Failure to enforce any right or provision in this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is deemed invalid, then that provision shall be deemed severable from the remaining conditions and shall not affect the validity and enforceability of any remaining condition.

    10. Assignment.

      You may not assign or transfer this Agreement and any associated rights or obligations, without Camdog’s prior consent. Camdog may freely assign this Agreement or subcontract its obligations without restriction.
